Alternative Dispute Resolution (ADR)
Alternative Dispute Resolution (ADR) incorporates methods for resolving disagreements that may arise in Special Education. Common points of dispute include the implementation of Individualized Education Programs (IEPs), assessment processes, timelines, and the appropriateness of special education services. ADR aims to achieve mutually agreeable outcomes, rather than relying on decisions imposed by a third party, such as a hearing officer or judge.
ADR employs specific practices that foster understanding, encourage open communication, and facilitate satisfying conflict resolution. The primary goal of ADR is to achieve student-centered outcomes early in the dispute process.
Information shared in the Alternative Dispute Resolution (ADR) process is fully confidential unless all parties agree to disclose it. ADR services are offered at no cost to families, making them accessible to everyone. Participation in ADR does not affect any party's right to due process. The process is designed to foster collaborative, mutually agreeable solutions, focusing on reaching written agreements that meet the needs of all involved.
